Appeal ruling of case between: Elusion 73 Pool club and BNB Ruwa Pool club

The crux of the matter stems from the fact that BnB Ruwa Pool Club played their match against Elusion 73 wearing jerseys that didn't have the sponsors' logo emblazoned on them, which was in contravention of the league constitution, namely Chapter 1.12 and 1.12a of the PPL Ancillary Rules. The anomaly was only noticed and brought to the umpire's attention during the 12th frame. Upon the anomaly being noted to ready remedy was arrived at on the day leading to the abandonment of the game. Therefore the league frowns upon non-completion of games. It is common cause that the wearing of a club Jersey without the sponsor's logo is unacceptable to the league, and as of mid-season last year this was made known to all clubs as it was communicated by the league SG to all clubs. Just because the ancillary rules don't prescribe a punishment doesn't mean the punishment is not known. No Logo no play is the league mantra. This rule was not effected by the sponsor but by the league. In recognition of the sacrifice of the sponsor to the league. The whole league benefits from the benevolence of the sponsor and we should not look a gift horse in the mouth. The sponsor accepted that the norm will be that his logo will be worn on all club jerseys and resultantly that must be adhered to at all costs 

We have taken into account the concerns of both parties and as a consequence will be amending sections of the DC ruling. There was a sense of shock induced by the huge fines meted out by DC and we will revise those to reasonable amounts without trivializing the gravity of the issues at hand


Verdict: 
There were various infractions by both parties which we will highlight below:

Elusion 73:

  1. Elusion 73 failed to send an official report detailing the reasons for the abandonment of the game during the stipulated time frames 
  2. Elusion 73 failed to conclude the match on the table nor find a solution to the impasse

Fine: $75

 BnB Ruwa:

  1. BNB Ruwa also failed to send their match report to DC within the stipulated timeframe.
  2. Failed to resolve the issue on the day and find a solution to ensure the game is concluded on the day
  3. Played a match  with uniforms that contravened the tenets of the league

Fine: $75 for failing to conclude the match on the day. And further $150 for the more grievous anomaly of not respecting the league statutes and playing a league game with improper uniforms
 
The league executive and its appendage the Umpire must ensure there isn't a repeat of the goings-on that resulted in the abandonment of the game. As a result of the culpability of the Umpire in the matter. He is to be fined 50% of two match fees he officiates in the league and warned of his future conduct. He and all-league umpires must exercise due diligence

Further, it shall be noted that at the time of the offense, the scoreline was 8 to 3 in favor of BNB Ruwa. It is ordered that those frames be forfeited and the gane be awarded to Elusion on a walkover scoreline of 10 to 0 as the matches were played under incorrect circumstances. It is not in the interests of anyone to find further resources to complete the fixture.  

In the matter raised by Elusion about the BNB Ruwa versus Pahukama. We can not delve into its merits as Pahukama has not reported the matter. 

The above is the complete appeal verdict and should the parties to the matter feel aggrieved they can take the matter further with the relevant authorities
